ABOUT THE RISKS

In view of the high risks, you should only carry out such transactions if you understand the nature of the contracts (and contractual relationships) you are entering into and if you are able to fully assess the extent of your risk potential. Trading with futures, f15options, forex, CFDs, stocks, cryptocurrencies and similar financial instruments is not suitable for many people. You should carefully consider whether trading is appropriate for you based on your experience, your objectives, your financial situation and other relevant circumstances.

Past performance gives no indication of future results.
We wish to point out to you some specific risks below that may result from trading with financial instruments.

RISKS ASSOCIATED WITH AUTOMATION TRADING

Before you begin carrying out transactions with an electronic or automation system, you should carefully review the rules and provisions of the stock exchange offering the system, or of the financial instruments listed that you intend to trade, as well as your broker’s conditions. Online automation trading has inherent risks due to system responses/reaction times and access times that may vary due to market conditions, system performance and other factors, and on which you have no influence. You should be aware of these additional risks in automation trading before you carry out investment transactions.

You should be prepared to lose all the funds that you use for day trading. In particular, you should not fund day-trading activities with retirement savings, student loans, second mortgages, emergency funds, funds set aside for purposes such as education or home ownership, or funds required to meet your living expenses. Further, certain evidence indicates that an investment of less than $50,000 will significantly impair the ability of a day trader to make a profit. Of course, an investment of $50,000 or more will in no way guarantee success.
As already mentioned, past performance does not give indication of future results.
In view of the above, there can thus be no guarantee or promise given for the success or profitability of investments made. By using this website, you expressly acknowledge and agree that SmartBotter cannot be held liable for any damages resulting from investments made.

None of the information made available by SmartBotter constitutes an invitation to trade in financial instruments or securities of any kind.

(“Trading”) involves a significant risk of loss  and is not suitable for all investors. Please note that the risk of loss in trading can be substantial. You should therefore find out the details of your financial situation and, if necessary, consult professional help to assess whether your personal and financial situation allows trading and whether you can take the high risk of loss.

Because SmartBotter is subject to risk of mechanical failures, it is very important to for you to monitor your trades. It is possible for an automated trading system to experience abnormalities that could result in errant orders, missing orders, or duplicate orders. If the system is closely monitored, these events may be identified and resolved.

You should also consider your level of trading experience with automated systems in deciding how you should choose your overall trading strategy. Highly complex strategies with many variables make it more difficult to determine whether the trades that will execute are designed to be profitable. Starting with simples automation strategies will allow you to develop experience and learn methods of trading that work best for you.

SmartBotter cannot be held responsible for possible losses or other damage. Consequently, no claims for damages can be asserted. Please also note that trading has a certain addictive potential. If you find yourself at risk, please seek professional help.

We urge you to take responsibility for obtaining advice regarding property law and to be informed professionally about all the risks and possibilities of trading, specifically automation trading. Before you make an investment decision, please contact your financial adviser.

RISKS ASSOCIATED WITH THE STOCK MARKET

All opinions, news, investigations, analyses, prices or other information or statements offered by SmartBotter are provided in the form of general remarks and comments. They do not constitute investment advice.SmartBotter assumes no liability for loss or damage, including, but not limited to, lost profits that may result directly or indirectly from the use or reliance on the above mentioned opinions, news, investigations, analyses, prices or other information offered by the company. In this regard we also refer to our General Business Terms and Conditions.

All the investment forms described here involve large financial risk. The past performance of a security, an industry, a sector, a market, a financial product, a trading strategy or the individual trade does not guarantee any future results or returns. As an investor, you yourself bear the full responsibility for your individual investment decisions. Such decisions should be based on an assessment of your financial situation, your investment objectives, your risk tolerance, and your liquidity needs and should be discussed in advance with your personal financial advisor in case of doubt.

RISKS ASSOCIATED WITH FUTURES TRADING

Futures transactions involve high risk. The amount of the initial margin is low compared to the value of the futures contract, so that transactions are “leveraged” or “geared”. A relatively small market movement has a proportionately larger impact on the funds that you have deposited or have to pay: this can work both for you and against you. You may experience the total loss of the initial margin funds as well as any additional funds deposited in the system. SmartBotter is an automation engine that decides the quantity of stock and option trades based on your selected loss preference. In case of malfunction, your predefined quantity may not be followed and you may incur in significant loss of money. You are responsible for closely monitoring, reviewing, and closing the trades selected by SmartBotter at the end of each trading day.

If the market develops in a way that is contrary to your position or if margins are increased, you may be asked to pay significant additional funds at short notice to maintain your position. In this case, it may also happen that your broker account is negative and you will need to make payments beyond the initial investment.

RISKS ASSOCIATED WITH OPTIONS TRADING

Trading in options involves considerable risk and is not a suitable form of investment for all investors. The risk in options trading that you will lose your entire investment within a relatively short period of time is comparatively high. It is possible that the loss and the resulting payment obligation will be higher than the funds invested through your securities account. Therefore, please be sure to check in advance on your trading broker’s terms and conditions of those of the custodian bank. Before you decide to invest in the options market, you should carefully consider your investment objectives, experience, financial resources and willingness to take risks. There is a possibility that you will experience a significant loss that can quickly exceed your initial investment.

RISKS ASSOCIATED WITH SHORT SELLING

Short sellers face unique risks, such as the risk that stock loans become expensive and the risk that stock loans are recalled. Short selling risk affects prices among the cross-section of stocks. Stocks with more short selling risk have lower returns, less price efficiency, and less short selling.

Market Risk

The market risk of short selling is one of the biggest risks of short selling. There is no limit on how high a stock can go; the potential market risk is unlimited.

Dividend Risk

The dividend risk is just as serious. When you day trade with funds borrowed from a firm or someone else, you can lose more than the funds you originally placed at risk. A decline in the value of the securities that are purchased may require you to provide additional funds to the firm to avoid the forced sale of those securities or other securities in your account. Short selling as part of your day-trading strategy also may lead to extraordinary losses, because you may have to purchase a stock at a very high price in order to cover a short position.

Spinoff Risk

In the case of more complex events, like a spinoff or issuing warrants, the potential losses can mount even more quickly. Even though you started one security to begin with, you could become short two securities (or possibly more) at the same time.

Short Squeeze Risk

Short squeezes can work against short sellers. A short squeeze happens when many trader short a stock, but the price goes up instead. GameStop Corporation in 2021 is an example.

Buy-in Risk

Stocks that are heavily shorted have buy-in risks, which refers to the closing out of a short position by a broker-dealer because it is hard to borrow, and lenders may want it back.

Regulatory Risk

Regulators may ban short sales in a particular sector or in the market in general. This may cause an unexpected spike in stock prices, which may force the short seller to cover short positions and incur in great losses.
